COVID-19 pandemic has taught us some important lessons on how to manage our business. During a time when many insurance companies would not cover losses, we found ourselves stepping in to cover losses we were unprepared to cover. These were waters never charted before and now moving forward we want to make sure both sides have a clear understanding of what is and is not covered and options to mitigate such losses in the future.
Tenants who are not permitted entry in to Cayman Islands due to health reasons and/or have not met entry requirements and/or any other reasons are subject to our standard cancellation policy. No refunds will be issued for reservations cancelled less than 30 days from arrival.
We strongly suggest that Tenants obtain CFAR (cancel for any reason) travel insurance if they are concerned they may not be able to travel due to their own circumstance or circumstance out of their control. Alternatively, consider choosing to pay a small premium to change our cancellation policy from 60 days to 1 day. The Buy-Down option will change our existing policy to reflect a 1-day notice period versus the current 60-day policy as detailed below. - General
- All bookings are subject to these terms and conditions.
- All prices are stated in USD.
- You have ensured you meet all the requirements for entry into Cayman Islands.
- Booking & Deposit
- A deposit of 25% of the total booking is required to reserve the dates.
- The booking will be confirmed upon receipt of the deposit and is not confirmed until such a confirmation has been received.
- Sending of the deposit confirms Tenants’ acceptance and understanding of these terms and conditions.
- The full balance is due 60 days prior to the date of arrival.
- The property will be available after 4pm on the arrival date unless otherwise agreed.
- The property must be vacated by 11am on the date of departure unless otherwise agreed.
- If Tenants solicit additional cleaning services, Tenants agree to pay a cleaning fee of $20 CI per hour directly to the cleaning service. The cost to clean the unit before and after the stay has been included in the rental fee.
- Cancellations
- Cancellation by Tenants
- Any cancellations must be made in writing with proof of delivery and/or electronically and acknowledged to be deemed received and will be subject to the following charges:
- More than 60 days before arrival: Full Refund*
- Between 59 – 31 days before arrival: Loss of 50% of total cost
- Less than 30 days before arrival: Loss of 100% of total cost (no refund)
- In the event of airport closure on either side of the scheduled flight, the value of the reservation will be issued a full credit to be applied against a future stay.
- In the event that the Tenants becomes ill and/or is prevented from entering the Cayman Islands resulting in not being able to use the property, we are not able to reimburse or credit for the rental fees paid.
- We will attempt to rent the period on the Tenants’ behalf and credit these funds should we be able to rent the same dates to another party.
- Any cancellations must be made in writing with proof of delivery and/or electronically and acknowledged to be deemed received and will be subject to the following charges:
- Cancellation due to Cayman borders closing
- More than 60 days before arrival: Full Refund*
- Between 59 – 31 days before arrival: Full Refund*
- Less than 30 days before arrival: 100% credit
- While on island: 100% credit for unused days
- Hurricane
- Hurricane closure is solely based on the Cayman Government issuing a travel advisory not to travel. Refunds based on above clause 3B
- Admin Charges on Refunds
- * Any refunds issued will incur an admin charge equal to the transaction fee (typically 3%). Payments made by credit card or PayPal have a transaction fee. To avoid possible admin charges, please consider paying by check or draft or using PayPal’s friends and family option.
- Right to Cancel
- We reserve the right to cancel the reservation and return any money paid.
- Cancellation by Tenants
- Tenants’ Obligation
- The Tenants shall be responsible for the safety and security of the accommodation, its contents and fixtures and fittings for the duration of the rental. The Tenants shall pay for any damage done to the premises over and above normal wear and tear to the satisfaction of the Landlord.
- Your liability for loss or damage caused is not limited to the funds already paid and the Landlord reserves the right to take action for the recovery of any additional losses sustained.
- All breakage or other loss incurred during the rental period must be reported to the owner within 24 hours of such breakage or loss.
- Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Landlord’s family. Toilet paper, soap, dish detergent, laundry soap, shampoos, and other consumables are to be purchased by the Tenants. No reimbursement will be made for unused consumables left at the premises. If consumables exist at the premises when the Tenants arrive the Tenants are free to use them.
- Liability
- During your stay the owners or owners’ agents accept no responsibility for any death, personal injury, accidents, loss or damage to persons or personal possessions however caused.
- We would strongly advise that appropriate travel and cancellation insurance is taken out for all members of the party traveling.
- Force Majeure – The owners or owner’s agent cannot accept, be responsible for or be liable in respect of loss, damage or changes caused by force majeure (e.g. pandemic, strikes, floods, closure of airports, weather conditions or other events beyond our control).
- No liability is accepted by us for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains services, nor any actions taken in the vicinity of the property by any authority over which we have no control.
- Valuable items left behind by Tenants will be held for the Tenants and every reasonable effort will be made to contact the Tenants for return. If items are not claimed for longer than 6 months, they shall become the property of the Landlord. The Landlord shall not be help liable for condition of said items.
- Safety & Accommodation
- The property has a fire extinguisher installed. The fire extinguisher was fully charged at last inspection. It is the duty of the Tenants to inform the Landlord immediately should the fire extinguisher become less than fully charged. Tenants agree to use the fire extinguisher only for true emergencies.
- The property has fire alarms installed and they are believed to function properly at the time of rental. Tenants will notify management without delay if a fire alarm “chirps” or has a low battery condition.
- The Tenants are advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one.
- The accommodation provided is only for the persons named by the party leader on the booking form. Subletting, sharing or assigning is prohibited.
- The Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
- The Tenants shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits.
- Persons under the age of 18 MUST be accompanied by an adult.
- The Tenants shall see to their own security while in the property by locking doors, windows, etc. when prudent to do so.
- The property must not be left unsecured at any time while you are away from the property, including patio doors.
- The Tenants agree not to access the “owner’s closet”, even if unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults. The Tenants will also ensure to move any cleaning chemicals out of reach of young children.
- Swimming Pool & Ocean
- Anyone using the swimming pool or ocean does so at their own risk. We cannot be held responsible for any loss or injury resulting from the use of the swimming pool or swimming in the ocean. NO LIFE GUARD ON DUTY.
- Tenants are hereby notified that the pool and or ocean can be dangerous and Tenants accept fully the risks involved.
- Children must not be allowed access to the swimming pool area without responsible adult supervision.
- Diving is strictly prohibited.
- Glassware and other breakable kitchen items are not permitted in the pool area.
- The swimming pool is cared for by trained personnel and it is vital that the correct chemical balance is maintained. To avoid upsetting this balance or causing damage to the filtration and heating systems, you must not introduce any chemical or soap product into the water.
- On rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it will be necessary for you to be out of the pool for a period of up to 24 hours for safety reasons.
- Other
- If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the Tenants’ stay. Every effort will be made to schedule the showing at a convenient time and not interrupt the Tenant’s vacation. Tenants shall allow reasonable viewings of the home between 10 am and 5 PM present or not.
- If the condo management has scheduled services such as but not limited to, pest control, HVAC maintenance, etc., the Tenants will allow reasonable access as requested by prior notification.
- Tenants agree to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by Landlord enforcing this agreement.
- Smoking & Animals
- For the comfort and safety of clients and guests smoking is not permitted within the condo or condo complex. Smokers may do so on beach. There will be an additional cleaning charge if the client and/or guests choose to ignore this condition of booking.
- Animals and pets are not allowed within the condo or on the grounds.
- Complaints
- In the unlikely event of a complaint during your stay please contact the owner immediately so that remedial action may be taken.
